Articles of agreement between John Cochran and Trustees of Centre College (March 1820)

Articles of agreement made and entered into this [blank] day of March 1820 between John Cochran of the one part, and the Trustees of the Centre College of Kentucky of the other part; witnesseth that for and in consideration of the canceling and annulling of that part of the contract heretofore made and entered into, between the said Cochran and Joshua Fry, Ephraim McDowell, and David G. Cowan, for and on behalf of the Trustees of the Danville Academy, which bound said Cochran to open streets though his lands, the said Cochran hath this day bargained and sold to the Trustees of said College, a certain piece or parcel of land which adjoined the tract heretofore sold by said Cochran to said Trustees of said College on the East end thereof.

Which piece or parcel of land hereby sold is bounded as follows to wit. Beginning at the South East corner of the College tract as surveyed and laid off by Archibald Bilbo Surveyor of Mercer County on the 3rd day of December 1818 and marked

on his plate thereof by the letter D running then north eighty eight and three fourths degrees east [illegible word] sixty feet thence north one and a quarter degrees west parallel to the east line of said College land till it intersects David McElroy’s line in the Main road leading from Danville to Perryville, thence westwardly with said McElroy’s line so far that a line running south one and a fouth degrees east will strike the beginning. It is the clear understanding and intent of the parties hereto, that no pecuniary consideration is to be paid to said Cochran in addition to the consideration above mentioned and the parties hereto do each release the other from all claim or demand upon the other which they might or could have by reason of the contract so entered into as aforesaid by the said Cochran of the one part and the said Fry, McDowell & Cowan of the other part – the said Cochran binds himself to make a good and sufficient title in fee simple by deed with general warranty whenever he shall be hereafter

requested by the Trustees of the said College.

In testimony whereof the said John Cochran hath hereto subscribed his name and affixed his seal, and David G. Cowan for and on behalf of the Trustees of said College, hath also affixed his name and seal.
